Unfortunately, with the increase in drug use in Kentucky – both legal and illegal – drug charges continue to rise. Abuse of prescription drugs (Xanax, OxyContin, Lortab, Demerol, Codeine, Amphetamines, Percocet, Methadone, Suboxin, Oxycodone, Vicodin, Lorcet, Valium, Percodan, Tylox, Ativan, Soma, Morphine) has lead to a dramatic upswing in the number of drug possession and drug trafficking cases in Kentucky.
Kentucky also continues to see a high number of defendants charged with trafficking and possession of illegal street drugs (cocaine, crack cocaine, meth, heroin, opium, ecstasy, methamphetamine, crystal meth, hallucinogens, LSD, PCP, rohypnol (roofies) and even marijuana.
Other drugs obtained or trafficked illegally that can lead to criminal charges include: steroids, human growth hormone (HGH), inhalants and hallucinogenic mushrooms (psilocybin mushrooms, shrooms, magic mushrooms).
In 2011 Kentucky House Bill 463 was signed into law. Most aspects of the bill took effect June 8, 2011. This bi-partisan bill was intended to decrease Kentucky's prison population by favoring treatment and rehabilitation for people charged with lesser drug crimes rather than long-term incarceration. HB 463 created the new KRS 218A.1412 also referred to by many as the "2011 Kentucky Drug Crime Bill." HB 463 also made significant changes to pretrial release procedures including bond (the term for "bail" used in Kentucky).
